[ Summary ] We analyzed the judicial decisions in medical malpractice litigations pertaining to sedation. Seven cases were retrieved from legal database ; in all cases, the hospital lost in the courts. In the majority of cases, the main negligent finding was inappropriate monitoring during sedation. We then examined the role of clinical guidelines in lawsuits. The guidelines are treated as important evidence in lawsuits ; therefore, every doctor should practice in accordance with these guidelines. Appropriate anamnesis, sufficient assessment of patient condition, adequate monitoring during sedation, and appropriate cardiopulmonary resuscitation are crucial to avoid medical accidents.
