| 【 要旨 】 | 本稿では，鎮静におけるリスクマネジメントを考えるために，まずは，わが国の医療訴訟の動向ならびに鎮静が関係した訴訟事例を紹介した．その後，ガイドラインの運用について検討した． わが国の医療事故訴訟件数は平成16年をピークに減少し，現在，年間800件程度で推移している．判例データベース上，鎮静が関係した民事訴訟事例は7事例あった．7事例すべて病院側が敗訴となっており，鎮静中の監視が不十分だったといったものが多かった． 厚生労働省や専門学会の診療ガイドラインは各種文献のなかでももっとも重視される証拠であり，行われた医療行為が適切だったか否かを決める医療水準の判断の基礎となるものであると考えられる．消化器内視鏡診療を行うすべての医療機関において，日本消化器内視鏡学会から公表されたガイドラインを踏まえたうえで内視鏡鎮静を行うことが望まれている． |

| [ Summary ] | We analyzed the judicial decisions in medical malpractice litigations pertaining to sedation. Seven cases were retrieved from legal database ; in all cases, the hospital lost in the courts. In the majority of cases, the main negligent finding was inappropriate monitoring during sedation. We then examined the role of clinical guidelines in lawsuits. The guidelines are treated as important evidence in lawsuits ; therefore, every doctor should practice in accordance with these guidelines. Appropriate anamnesis, sufficient assessment of patient condition, adequate monitoring during sedation, and appropriate cardiopulmonary resuscitation are crucial to avoid medical accidents. | |
